This position sits at the intersection of construction law, engineering logic, and financial forensics. The primary goal is to resolve disputes—such as delays, cost overruns, or defects—through negotiation, mediation, adjudication, or formal litigation and arbitration. Core Responsibilities

  1. Case Analysis & Strategy • Contractual Review: Analyzing complex contracts (often FIDIC, NEC, or JCT suites) to determine risk allocation and liability. • Claim Preparation: Drafting or defending against formal claims related to Extensions of Time (EoT), liquidating damages, and variations. • Quantum Assessment: Working with quantity surveyors to calculate the financial impact of project disruptions.
  2. Dispute Management • Arbitration & Litigation: Managing the "heavy lifting" of formal proceedings, including drafting witness statements, managing document disclosure (e-discovery), and briefing Counsel. • Alternative Dispute Resolution (ADR): Representing clients in mediation or adjudication (common in the UK/UAE/Australia) to reach settlements without trial. • Expert Witness Coordination: Liaising with technical experts (delay analysts, forensic engineers) to simplify complex technical data for a judge or arbitrator.
  3. Risk Mitigation & Advisory • Real-time Advice: Providing "live" project advice to developers or contractors to prevent issues from escalating into formal disputes. • Conflict Avoidance: Advising on project governance and record-keeping standards to ensure the client is protected if a dispute arises. Requirements: Requirements • Education: Bachelor of Laws (LLB/JD) or a degree in Civil Engineering/Quantity Surveying with a legal conversion. • Technical Knowledge: Deep understanding of Delay Analysis methodologies (e.g., Critical Path Method) and construction technology. • Soft Skills: High-level negotiation, resilience under pressure, and the ability to explain technical engineering failures in plain English.
